Right of Withdrawal

This page informs you about your statutory right of withdrawal pursuant to Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, as transposed into Austrian law by the Consumer Rights Directive Implementation Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG).

1. Your Right of Withdrawal
You have the right to withdraw from your contract with LISA Film GmbH within fourteen (14) days without giving any reason. The withdrawal period expires fourteen days after the day on which the contract is concluded. This right applies to all subscriptions and purchases made on CZWTV.com as a distance contract within the meaning of Section 3(1) FAGG.

To exercise the right of withdrawal, you must inform LISA Film GmbH of your decision to withdraw from the contract by means of an unequivocal statement. You may use any of the following methods:

You may use the model withdrawal form set out below, but this is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

2. Effects of Withdrawal
If you withdraw from the contract, LISA Film GmbH shall reimburse to you all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed of your decision to withdraw from the contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. If you paid via credit card, the refund will be credited to the same credit card. If you paid via bank transfer, we will refund to the bank account from which the payment originated.

3. Refund Process and Timeline
Upon receiving your withdrawal request, we will:

(a) Acknowledge receipt of your withdrawal within two (2) business days by email.
(b) Process your refund within fourteen (14) days of receiving your withdrawal notice.
(c) Send a confirmation email once the refund has been initiated.
(d) Depending on your payment provider, refunds may take an additional three (3) to five (5) business days to appear in your account after we have processed them.

If only part of a subscription period has elapsed, you will receive a pro-rata refund for the unused portion of the current billing period, unless the exception for digital content described below applies.

4. Exceptions — Digital Content
Pursuant to Article 16(m) of Directive 2011/83/EU and Section 18(1) item 11 FAGG, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and the consumer's acknowledgement that they thereby lose their right of withdrawal.

Specifically, this exception applies in the following cases:

(a) Streaming upon subscription activation: If, during the sign-up process, you expressly consented to the immediate provision of the streaming service and acknowledged that you would lose your right of withdrawal upon accessing any content, the right of withdrawal ceases once you have begun streaming or downloading content on the platform.

(b) Individual purchases or rentals: For one-time purchases or rentals of individual films, episodes, or live events, the right of withdrawal ceases once the playback of the purchased or rented content has begun.

(c) Live events: For live broadcasts and events tied to a specific date and time, the right of withdrawal expires once the live event has commenced.

During the checkout process for any digital content or service, you will be asked to provide your express prior consent to the immediate commencement of the service and to acknowledge that you will thereby lose your right of withdrawal. Without this consent, the service will not commence until the expiration of the withdrawal period.

6. How to Submit Your Withdrawal
To submit a withdrawal, we recommend the following steps:

(a) Copy the Model Withdrawal Form above, fill in the required information, and send it via email to [email protected] with the subject line “Withdrawal Request.”

(b) Alternatively, write a clear statement containing your full name, your registered email address, a description of the service or subscription you are withdrawing from, and the date of the original order.

(c) You may also submit a withdrawal by sending a letter to: LISA Film GmbH, Seecorso 4, 9220 Velden am Wörther See, Austria.

(d) Upon receipt, our support team will confirm your withdrawal within two (2) business days and initiate the refund process as described in Section 3 above.
